There was a regular meeting of the Kilkenny City Council held in Council Chambers starting at 7:00 p.m. on January 9, 2017.

  1. Call to Order Mayor Kevin Taaffe Jr., called the meeting to order at 7:00 p.m.

  3. Approval of Minutes. Regular meeting held December 12, 2016. Motion by Jeff Baldwin, seconded by Terry Ferch to approve minutes as written. Unanimous vote. Motion carried.
  4. Approval of Special Meeting. Special meeting held December 12, 2016. Add Dale Sorget. Motion by Jeff Baldwin, seconded by Terry Ferch to approve the amended meeting minutes.
    1. Approval of agenda. Motion by Jeff Baldwin, seconded by Luke Wetzel to approve the amended agenda. Unanimous vote. Motion carried.

  1. New Business.

A)    Email Update. Clerk Tanya Hankins told the council she only received one response from other city clerks in the area about who they have as their website controller and asked the council what they’d like to do. Mayor Taaffe asked if the website was updated as of currently and Mrs. Hankins said everything is updated and she received all information and passwords from Mr. Ferguson. Mayor Taaffe said that he and Mrs. Hankins would talk about it in the coming weeks and currently we will try to keep it updated ourselves.

B)    Faribault Paper Machine. Mrs. Hankins informed the council the city had received a phone call from the Faribault newspaper regarding getting a paper machine put outside the fire hall. Mrs. Hankins said the paper machine would be free of charge to the city and there is someone from the newspaper whose route is to go past Kilkenny so they will be attending to and taking care of the machine. There will be two papers available to the public of which are also free of charge. The council discussed and decided it would be okay for the paper machine to sit under the awning by the city clerk’s office where it is out of the way of the fire department and as far away from weather as possible.

C)    Library Resignation Letter. Janeice Bull gave the council a letter to the council for her immediate resignation from the city library effective immediately. She mentioned she has no hard feelings and does not have the time to do it anymore. Motion by Jeff Baldwin, seconded by Luke Wetzel to accept the librarian resignation. Unanimous Vote. Motion Carried. Mayor Taaffe asked what the council would like to do with the library in the meantime being they are short staffed to keep it open. Kara Hackett said she is too busy to fill in the vacant hours. Mayor Taaffe said as of now they are going to temporary close and discuss what to do later.

D)    Fire Dept. Elections.

  • ·        Captain 2- Vacancy declared by Fire Dept. Motion by Luke Wetzel, seconded by Jeff Baldwin to wait on vacancy of Captain 2 declared by the Fire Dept. to be approved once someone is found. Unanimous Vote. Motion Carried.
  • ·        Training Officer Fire- Cameron Hankins. Motion by Luke Wetzel, seconded by Jeff Baldwin to approve Training Officer Fire Cameron Hankins. Unanimous Vote. Motion Carried.
  • ·        Training Officer Rescue- Terry Ferch. Motion by Luke Wetzel, seconded by Jeff Baldwin to approve Training Officer Rescue Terry Ferch. Unanimous Vote, Motion Carried.

(1)   Chief Landrum said the only thing the fire dept. is looking for this year is to have more training for the fire dept. members to attend.  

  1. Annual Organizational Consent Agenda

A)    Acting Mayor:  Motion by Cameron Hankins seconded by Terry Ferch to appoint Luke Wetzel as Acting Mayor. Unanimous vote. Motion carried.

B)    Depositories.  Motion by Luke Wetzel, seconded by Cameron Hankins to use The First National Bank-Kilkenny Branch as the City’s depository. Unanimous vote. Motion carried.

C)    Newspaper:  Motion by Terry Ferch, seconded by Luke Wetzel to have Lake Region Life as the city Newspaper.  Unanimous vote.  Motion carried.

D)    Engineer:  Motion by Luke Wetzel, seconded by Jeff Baldwin to appoint Boltman & Menk as city Engineer. Unanimous vote.  Motion carried.

E)     Weed Inspector:  Motion by Luke Wetzel, seconded by Terry Ferch to appoint City Maintenance as the Weed Inspector.  Unanimous vote.  Motion carried.

F)     Blight Inspector Motion by Luke Wetzel, seconded by Terry Ferch to appoint Jeff Baldwin as the Blight Inspector. Unanimous vote. Motion carried.

G)    Council Meetings:  Motion by Luke Wetzel, seconded by Jeff Baldwin to hold the regular council meetings second of the month at 7:00 pm.  Unanimous vote.  Motion carried.

H)    City Attorney:  Motion by Jeff Baldwin seconded by Cameron Hankins to retain Jason Moran of Christian, Keogh, Moran and King  as the City’s Attorney. Unanimous vote. Motion carried.

I)       Back up Water Meter Reader: Motion by Luke Wetzel seconded by Terry Ferch to retain Cameron Hankins as the backup water meter reader. Unanimous vote. Motion carried.

J)      Building /Zoning Permits: Motion by Luke Wetzel seconded by Terry Ferch to appoint Jeff Baldwin as the contact for building and zoning permits. Unanimous vote. Motion carried.

10.  Unfinished Business

A)    None

11.  Approval of Disbursements. Motion by Luke Wetzel, seconded by Jeff Baldwin to approve the City’s disbursements. Unanimous vote. Motion carried.

12.  Impress Cash Fund. Impress cash fund doesn’t need to be reimbursed this month.

13.  Citizen Time

A)    Tim Sellner there are some things that can be done with the hydrants for the ISO that Chief Landrum had brought up for the fire dept. He said he is going to check with Rural Water and that it can be done when he flushes hydrants. Mayor Taaffe asked Chief Landrum if it would be okay for Mr. Sellner to use one of the grass rigs when flushing hydrants instead of using a his personal vehicle since the grass rig is a city vehicle. Mr. Sellner asked if it mattered which truck he used, said he had gotten some grief before when using one of them. Mayor Taaffe and Chief Landrum said it doesn’t matter which one he use but suggested the Chevy be driven. Motion by Luke Wetzel, seconded by Jeff Baldwin to approve the use of the grass rig for the city employee for the purpose of flushing fire hydrants. Unanimous Vote. Motion Carried. Mr. Sellner said he’d like to disregard the services of KLM_38 minutes__. Mr. Sellner would like to suggest the hiring of McGuire out of Sioux Falls to do the inspection of the water tower. Mr. Sellner said he did his research of both companies and that KLM brings in crews from other companies to do the work but McGuire has their own crew to finish the work themselves. Motion by Jeff Baldwin, seconded by Luke Wetzel to accept the contract for Cleaning and inspection of the water tower by McGuire. Unanimous Vote. Motion Carried. Mr. Sellner said there is a resident that is pushing the snow from their driveway into the street for the city plows to take. Mayor Taaffe said that is not allowed and a letter needs to be sent to them informing them of the issue. Jason Moran said he would take care of drafting up the letter.

14.  Council Discussion

A)    Luke Wetzel was wondering about the treasurer’s computer. Mayor Taaffe said he talked to Tara and she said her computer is crashing and she will need a new one soon. Mayor Taaffe then said he wanted to ask the council how much they would like to approve up to for her to get a new computer. Motion by Luke Wetzel, seconded by Cameron Hankins to approve up to a thousand dollars for the computer, and Microsoft office suites and for Treasurer Tara to pick it up herself. Unanimous Vote. Motion Carried.

B)    Mayor Taaffe mentioned the council got the code of conduct in their packets and asked each member to review and follow the code of conduct now and in the future.

15.  Closed Session – Discussion of Labor Negotiation. Motion by Terry Ferch, seconded by Luke Wetzel to close the open meeting at 7:51pm and move into a closed session. Motion Carried. Unanimous Vote

16.  Open Session. Motion by Jeff Baldwin seconded by Cameron Hankins to move back to open session. Unanimous Vote.

17.  Open Session. Reopened at 8:54 pm.

18.  Adjourn. Motion by Luke Wetzel, seconded by Jeff Baldwin to adjourn the meeting at 8:54pm.

There was a special meeting of the Kilkenny City Council held in Council Chambers starting at 6:45 pm on December 12th, 2016

  1. Call to Order. Mayor Kevin Taaffe Jr. called the meeting to order at 6:47 pm.
  2. Pledge of Allegiance.
  3. Discussion:
    1. Question arose as to why it took so long for the annexation to come into play since the building went up a while ago. Mayor Taaffe said the question would have to be brought up to the city attorney when he arrives and asked if the building owners attend any township meetings to bring this up? The members of Kilkenny Township said nobody attended any meetings or brought anything up to the township board. City attorney Jason Moran informed the crowd that the Knish’s came to the city council to petition to be annexed into the city. Mr. Moran said the township would have to take the issue up with the Knish’s who were absent as to why they built the building before the annexation was complete. The township asks that in the future these things be brought up to the township beforehand and be brought into the loop sooner than they were this time. Mayor Taaffe apologized that they were not notified of the issue earlier and said in the future they will be informed immediately and ask that the gesture be returned.

There was a regular meeting of the Kilkenny City Council held in Council Chambers starting at 7:00 p.m. on December 12th, 2016.

  1. Presentations

A)    Ordinance NO.: 2016-02 ANNEXING LAND LOCATED IN KILKENNY TOWNSHIP. Motion by Jeff Baldwin seconded by Luke Wetzel to annex a portion of land located in Kilkenny Township. Unanimous Vote. Motion Carried.

B)    FEMA: Gene and Jill attended the meeting to give information from the city residents about storm damage from the flood this past late summer. Basically they are trying to get home owners to register that have had damage not only applying to water damage but it could be damage from wind, trees falling, etc. It was asked that the city residents be informed of this benefit and fliers have been put up around the city and e-posters are made for people to access the fliers.

A)    Mail in Ballots-Discuss? Tanya informed the council that the city received a letter from the court house informing cities about mail in ballots. Tanya informed the council about the purpose of the mail in ballots and the benefits it can have. The council decided to pass on the mail in ballots and that they think the public enjoys having some place to go and vote and register to vote.

B)    Tony Ferguson resignation. Tanya informed the council about our city website operator emailing in his resignation. As of December 31st, 2016 he will no longer be our website operator and the city needs to find someone new. A note is going to be put into the newsletter asking if anyone in town is interested in the job and knows how to do it, also Tanya is going to ask other cities who they have as a website operator.

A)    No unfinished business.

10.  Approval of Disbursements. Election judges were paid the wrong amount per hour, checks will be issued next month for that extra pay. Firefighters have not yet been paid, but they will be paid at their fire meeting on Monday December 19th.  Motion by Terry Ferch, seconded by Jeff Baldwin to approve the City’s disbursements and include the Firefighter’s checks and the pay correction to election judges. Unanimous vote. Motion carried.

11.  Impress Cash Fund. Impress doesn’t need to be reimbursed this month.

12.  Citizen Time

A)    Cameron Hankins brought up the issue of some of the snow piles and how there are a lot of blind spots which is making the intersections dangerous and the piles are pushed onto light poles. Tim said the county and residents push the snow out of their driveways to make more room and Mayor Taaffe suggested pushing the snow down the street where there is more room.

B)    Mary Villwock asks that the hydrants be flushed more often, they are getting black water occasionally and there is usually a tinge color to the water and that other people in town are complaining. Tim said that there is always going to be a color to our water and that he has been flushing hydrants at least once a month.

C)    Tim Sellner in the future they will be hooking up the Knish’s new building into the city water. He also asked that something be put out that vehicles need to be moved for the winter season. He is also having an issue with residents being disrespectful not realizing he is a city employee plowing and not just a resident. He also said he is running out of hours to get some of the projects done in town such as doing water and plowing. He suggested either upping the hours he can work for the city or hiring someone else to do the plowing so it does not interfere with doing the water. Jeff and Mayor Taaffe said the city might have to think about making a maintenance position for the city. Mayor Taaffe brought up the fact that we are paying people to do little tasks for the city and maybe they could turn this into a part time job for someone for the city.

13.  Council Discussion

A)    Luke Wetzel was wondering if the second quote for the lift station has come yet, Tanya informed them that she has not received anything. Luke was also wondering about Tara’s new computer. Mayor Taaffe said Rex was going to get quotes for a new computer but Luke was wondering if she actually wanted a new one or if she just wanted a new power chord since during the budget meeting she sounded reluctant on getting a new one

B)    Terry Ferch said the fire dept. is in need of a new fridge and was wondering if it was a responsibility of the city or the fire dept. Mr. Moran said that is a fire dept. issue and needs to be brought up to them.

C)    Jeff Baldwin said he has not yet gone to check sump pumps with Tim yet and he is unsure of if it will happen before the end of this year or not. Mayor Taaffe thinks the inspection should be moved to spring and not worry about it this winter.

D)    Mayor Taaffe asked the council to start thinking about some evening entertainment for this coming Halfway event and that the first planning meeting will be held Monday, April 3rd, 2017

Citizen Time
Cameron Hankins brought to the city council that his home’s water is brown and the faucet needs to run a while before it clears up. Luke mentioned that he had to replace his water heater in order to see clearer water. Terry said she thinks the hydrants need to be flushed again and said she will get in contact with Tim. Cameron also mentioned the fact that the last couple of months his water bill is out of whack when they are usually very constant. Rex thinks something needs to be mentioned to Tim to see if there are any problems with the readings.
Janeice Bull takes pictures for the city events and puts them up on Flicker so they can be posted on the city website. She said it has cost $24 a year in the past to open this account and this year she is unable to get into the account. The website is asking for an email account for the city that is a yahoo account of which nobody knows what the password for that account would be for. Rex said he would email Tony to see if he would have the password for that email.
Council Discussion
Terry Ferch a new family that has moved into Ann Sheridan’s place has a boat that sticks halfway out into the alley. Rex mentioned it needs to be moved soon in case it snows soon and the snow plows start moving. Terry also brought up that someone in town was chased by a pit bull dog and that the sheriff was called. The sheriff advises that if this happens again to not bring the issue up to only the city council, call the sheriff’s dept. Terry was also wondering if anything has been done yet about the sump pumps. Jeff said he has not had the time yet to get started or be in contact with Tim.
Luke Wetzel is once again wondering on the status of getting the street signs put back up. They have the posts and just need the signs. Rex mentioned someone should get in contact with Tim about it since he was originally the person who was going to get them put back up. Luke also brought up the email in the council member packets for a band interested in playing for the Halfway to St. Paddy’s day event and that they need to keep track of things to start planning next month. Luke also was wondering if the city ever received a second quote for the pumps. Luke was wondering if Tara had gotten herself a new computer yet, no one was sure if she did or not. Luke thought she might not want to get a new computer and just wants a new power cord instead of using her son’s power cord. He mentioned someone should clarify this with her.
Jeff Baldwin mentioned that neither the city’s Treasurer nor Clerk were at the meeting and was wondering if that was going to be the new norm? Terry said Tara has said in the past if she is required to attend the meetings she would be quitting, and Janeice informed the council that Tanya was missing due to her son being sick.

KILKENNY CITY COUNCIL
REGULAR MEETING
OCTOBER 10, 2016


There was a regular meeting of the Kilkenny City Council held in Council Chambers starting at 7:00 p.m. on October 10, 2016.

Council in attendance: Mayor Kevin Taaffe Jr., Luke Wetzel, Rex Bull, Terry Ferch, Jeff Baldwin

Call to Order. Mayor Kevin Taaffe Jr. called the meeting to order at 7:00 p.m.
Pledge of Allegiance
Approval of Minutes. Regular meeting held September 12, 2016. Motion by Jeff Bull seconded by Terry Ferch to approve amended minutes as written. Unanimous vote. Motion carried.
Approval of agenda. Motion by Jeff Baldwin seconded by Luke Wetzel to approve the amended agenda as written. Unanimous vote. Motion carried.

Presentations
Liquor License- Renee had questions about the breakdown of the liquor license for Murphey’s Pub. Mayor Taaffe told her the breakdown: On sale $1000, Off Sale $100, and Sunday $200 for a total of $1300.
New Business
Half-way recap- Councilmen Rex made up a breakdown sheet the best he could of the numbers of how the day turned out for the halfway event. If we could get receipts from our treasurer Mrs. Robinson we could get a better idea of the gains and losses from the halfway event. Janeice Bull said that putting this together has helped give them a better idea of what is worth having at the event and what could possibly be eliminated for future events. Mayor Taaffe suggested the council schedule a special meeting for the upcoming months to tackle the planning sooner. A few people suggested a different weekend being that so many events are going on in the area that weekend each year. Mayor Taaffe made the point that being that the Church Festival in town is the next day; it helps bring more people into town for the whole weekend. Motion made by Rex Bull seconded Terry Ferch by  to schedule Halfway to St. Paddy’s Day event for Saturday September 16th, 2017 and from heron out mark the third Saturday of September the official date of the Halfway Festival. Unanimous Vote. Motion Carried. Next Halfway planning meeting is scheduled for Monday December 5th, 2016.
Knish Annexation Meeting – Attorney Jason Moran asked the council to schedule a Public Meeting fifteen minutes prior to the December monthly meeting to discuss the Knish Annexation. Motion by Jeff seconded by Luke to schedule a public meeting at 6:45 for December 12th for the Knish Annexation. Unanimous Vote. Motion Carried.
Unfinished Business
Go-Daddy Website Renewal – due October 30th. Motion made by Jeff Baldwin seconded by Rex Bull to approve the renewal of Go-Daddy for Kilkenny’s city website. Unanimous Vote. Motion Carried
Pump Works Quote- Rick Vollbrecht informed the council that due to last month’s heavy rainfall there was 88,000 gallons of rain water go into the lift station drain into the pond. When the system was first built there was too much drainage tiles draining into the lift station. Rick had someone do an emergency discharge for 3 days to help with the excessive water. Rick suggested having the council discuss drafting a sump pump ordinance for the city. City Attorney Jason Moran mentioned he had previously drafted one for the city of Le Center; he could do the same for the city of Kilkenny. Rick thinks the easiest would be the sump pump inspection first and see how much of a problem the city really has. Mayor Taaffe asked Mr. Moran to look into a city ordinance for the sump pumps. Rick said he had talked to another company for a quote for the pump works, the city has not yet received it so he will talk to the person he met with previously to get the quote sent to us. Lastly, Rick told the city council he’d like them to think about getting a portable generator for the future, he said he’d be okay with a permanent generator that runs and tests itself, but discussed the benefits of a portable one.

Citizen Time
Kathy Pittman was wondering about her check for working for the August elections. Mayor Taaffe asked Mrs. Hankins about it, she said a sheet for logging hours was sent to each person and if you didn’t leave one behind the day of elections or hand it in to Tanya, then it didn’t get handed in, but if you wait till November to hand in your sheet then both elections are lumped into one check. Mayor Taaffe looked on September’s receipts and didn’t see a check written for Mrs. Pittman, and asked what hours she worked, he said he would let Mrs. Robinson know and get a check out to her.
Council Discussion
Jeff Baldwin is concerned about the sump pump situation and asked the council what their thoughts were on it. Mayor Taaffe said he doesn’t think Tim Sellner should go out by himself, someone should go with him. Mayor Taaffe said a letter from the city will need to be sent out to all residents informing them on the situation and then an inspection will be done. Mayor Taaffe suggested starting out with an inventory of what houses have sump pumps and which ones don’t and go from there. Mayor Taaffe asked Councilman Baldwin if he would be willing to go with Tim to do the city wide check. Mayor Taaffe asked Mrs. Hankins to put this information in the city newsletter for November so all residents are aware someone will be coming to check for sump pumps.
Terry Ferch told the council that there have been a lot of complaints from the Halfway to St. Paddy’s day event about one of our city council members and that people of the city would like to see some action taken towards this council member. Mayor Taaffe said the right way to bring this issue up would be for the people who are complaining to write a letter to the city describing what happened at the halfway event and not confront a city council member.
Luke Wetzel found the signs in the city library and just needed the hardware to be round up; Tim was in charge of finding the hardware, councilman Luke was just checking in on it. Mayor Taaffe said there are posts at every street intersection, but the signs just need to be put up.
Rex Bull was wondering on getting paid for special meetings and if the council gets paid for the special meeting’s that happen fifteen minutes before the regular scheduled meeting. City Attorney Jason Moran said those those meetings should be referred to as ‘Public Meetings’.
Closed Session. Motion by Jeff Baldwin seconded by Luke Wetzel to close the open meeting and move into a closed session. Motion Carried. Unanimous Vote
Open Session. Motion by Jeff Baldwin seconded by Luke Wetzel to move back to open session. Unanimous Vote
Adjourn. Motion by Luke Wetzel seconded by Terry Ferch to adjourn the meeting at 8:55 pm. Unanimous Vote. Motion Carried.
