September 12, 2016


There was a regular meeting of the Kilkenny City Council held in Council Chambers starting at 7:00 p.m. on September 12, 2016.

Call to Order. Rex Bull called the meeting to order at 7:03 p.m.
Pledge of Allegiance
Approval of Minutes. Regular meeting held August 8, 2016. Motion by Jeff Baldwin seconded by Luke Wetzel to approve minutes as written. Unanimous vote. Motion carried.
Approval of agenda. Motion by Luke Wetzel seconded by Jeff Baldwin to approve the agenda as written. Unanimous vote. Motion carried.
Approval of Minutes. Meeting minutes were not approved for August 24th and September 7th meetings.

New Business
Murphey’s Pub Liquor License Renewal. Motion by Jeff Baldwin to approve Murphey’s Pub Liquor License, seconded by Luke Wetzel. Unanimous vote. Motion carried.
Approval of Proposed 2017 Budget. The council decided on adding an additional $2685 to the overall proposed budget for 2017. Motion made by Luke Wetzel to approve the 2017 Annual Budget as amended, seconded by Terry Ferch. Unanimous vote. Motion Carried.
Annexation Petition for Dan Knish’s Property. Motion by Jeff Baldwin to accept the proposed annexation for Dan Knish made up by city attorney Jason Moran, seconded by Luke Wetzel. Unanimous vote. Motion Carried. Motion made by Luke Wetzel to schedule a public hearing at 6:45 pm on Monday November 14th, 2016 for the property annexation of Dan Knish, seconded by Jeff Baldwin. Unanimous vote. Motion carried.
New Pump Works Quote. Councilman Wetzel would prefer to have a second bid from another business to compare quotes. The council decided to table the matter for right now until a second quote is received. The council would also like Mr. Vollbrecht to be present to discuss the matter with him.
Go Daddy-Website Renewal. At this time the council members decided to table this until next month.

Approval of Disbursements Motion by Luke Wetzel seconded by Jeff Baldwin to approve the City’s disbursements. Unanimous vote. Motion carried.
Impress Cash Fund. Impress doesn’t need to be reimbursed this month.
Citizen Time
John Lustig and Joanne Culhane both have black in their water. Tim Sellner said he would flush all of the hydrants to see if it would help with the water issue. Tim suggested a new water system might need to be in place and that it would be spendy. He is going to try a temporary fix by running a hose to John and Joanne’s house and keep track of the meter to try to see if that fixes the problem. He also mentioned that behind his house there are 3 abandoned vehicles that never move and are no longer licensed. Jeff said if they are on the city street and do not have valid tabs, or valid insurance on them that he should call the Sherriff.
Judy Claffey was wondering if anybody has gotten relief from the mosquitoes’. She mentioned that she’d like to see someone else hired for next year to spray the town. It was then mentioned what will be done for the Halfway event coming up. Tim mentioned he has a powder he tried out previously and would likely put this down on Thursday night before the event. He also mentioned for next year that he knows of a device we could purchase ourselves and buy chemical on top of it and we could do it ourselves. Terry and Luke both mentioned it’s been a particularly bad year for mosquitoes and we are not the only ones struggling with the problem, but that something needs to be changed for next year.
Council Discussion
Luke Wetzel was asked about the street signs again. He was wondering where to find the mounting hardware, Tim said he would work to gather it all up.
Jeff Baldwin wondering if the rust came off the water tank, Tim said he was able to scrub it off and it’s taken care of.

There was a budget meeting for the Kilkenny City Council held in Council Chambers starting at 6:30 p.m. on Wednesday September 7th, 2016.

Call to Order. Mayor Kevin Taaffe Jr., called the meeting to order at 6:30 p.m.

Approval of Agenda Motion by Luke Wetzel seconded by Rex Bull to approve the agenda as written. Unanimous vote. Motion carried.

New Business.
2017 Annual Budget: Mayor Taaffe first asked the council to review the budget and then decide how they would like to tackle it. Ms. Robinson said there haven’t been many changes to the original budget, only a few lines changed due to the street project.
New Computer: Ms. Robinson said her computer charger no longer works; she has been borrowing her son’s computer charger. Mayor Taaffe asked the council if they’d have enough room to purchase her a new computer.
Dues and Subscriptions: The council decided to add an additional $250 to this category to make it a total of $750, to make up for Ms. Robinson’s Notary that gets renewed every 5 years.
Real Estate Taxes: Recent purchase of a metal shed on an empty lot for a reoccurring cost of $94 yearly. Council decided to adjust this line to $150. Mayor Taaffe said they could probably make that money up somewhere else.
Repair and Maintenance: Rex said he’d like to do some repairs up at the city park regarding the swings and landscape of the park itself. Luke said this year alone the city is already over budget, Rex said he’d like to add an extra $1000 to make this budget line $1500 total.
Water: Council decided to take $1000 out of Administrative LP Gas and put it into Water LP Gas.
Revenue:  The $2000 budgeted for Kickball will be moved into Community bumping the community line up to $4000.

Total added is $1375 - Property Taxes: LGA is $1310 or approx. $16 per household. Overall changes made are $2685 adding to 2017’s budget. Mayor Taaffe said he personally doesn’t want to see any cuts in the budget, he thinks the increase made to this following year’s budget is pretty fair at an increase of approx. 1.9%  New 2017 budget will be : $142,414 Revenue stays the same.
Taxes: Total budget cost minus any revenue minus LGA whatever is remaining gets split amongst everyone’s taxes.

Council Discussion
Mayor Kevin Taaffe Jr. mentioned he spoke with the DOT about re-routing traffic for the halfway festival. As of Friday night September 16th traffic will be re-routed to Dodd road, take a right on Laurel Ave, a left on Ash and a right on County road number 3 for the weekend. Volunteers will be out to control traffic for the Fun Run/Walk. We are allowed to change the signs ourselves on Friday night, and can return them to normal on Saturday night wait for them to be changed on Monday morning. Mayor Taaffe also mentioned he will not be at the council meeting scheduled for Monday September 12th. Also, Friday night September 16th there will be a dinner for the council members, city employees, and Irish Guests. Tuesday evening Mayor Taaffe is picking up the Ireland Mayor and they are heading to Maplewood Hurling Club, anyone is invited. Wednesday they will be heading up to St. Paul and then having lunch with Minnesota Wild to launch an initiative for Hockey in Ireland. Thursday will be a hang out and explore day and at night Andrew McGuiness will be playing in Waterville. Friday morning they will be going on a private tour at Traxlers Preserve. That afternoon they are planning on doing a trap shoot. Friday night will be the social event with the guests and Council members. Everyone is then invited to the Liquor Hole for a performance by Andrew McGuiness. Saturday is the Halfway event and Sunday is the Church Festival and the guests are then leaving.

Presentations
Halfway to St. Paddy’s Day- Advertisements for Halfway to St. Paddy’s day will be up in the following towns: Waterville, Montgomery, Le Center, Elysian, Morristown and Shieldsville. Mark Pitman asked if anyone was getting the trophies for the toilet bowl races, Mayor Taaffe said the committee said they needed to get the plunger and toilet seat/cover yet for the races and paint them. Mark mentioned they need a handful of people to help set up and tear down the stage for the day of the map. Tim Sellner mentioned they will also need a crew to set up and tear down and maintain the fencing area for the beer garden. Mayor Taaffe said he was going to mention to the KC’s that they need to have volunteers/workers to monitor the fenced in area for the night.
Library- Kara Hackett said the bouncy house is all ordered for the halfway event. For $75 it covers the cost of the bounce house, delivery, set up and tear down. Kara also said Connie had to resign from her librarian spot with the city library. She sent a letter of resignation to the city email, Janeice Bull said she talked to her daughter Nicole about the open position and she is possibly interested in it.
New Business
City Claim – June 15th, 2016 Tornado and Wind Damage to Swings and Scoreboard in Park- Jeff Baldwin said the score board knocked down and ties busted from the wind damage. Mayor Taaffe said he would talk to our insurance agent Randy Hunt to see if it is even worth making a claim.
Schedule Budget Meeting- A budget meeting has been scheduled for Monday, August 29th, 2016 at 6:30pm.
Unfinished Business
Resolution NO.: 2016-02 A Resolution Vacating a Portion of a Public Alley. - City attorney Jason Moran said he tried to get in contact with the previous city attorney about the possibility of the alley being vacated many years ago but had not heard anything back. He was able to find a resolution after a lot of digging to find out the resolution was passed and the alley was previously vacated. The only thing is the resolution was not properly documented of which it is not legal. Jason was able to get a survey done on the alley and he agrees the document is not legal. The county surveyor has determined presently Dusty Balfe has received none of the property from the previous vacation and Dusty Spitzack has received it all. Jason has recommended the council table the matter as of right now and wait to see what the county surveyor comes up with. Jason is guessing there will have to be a new alley vacation drafted and reviewed.
Perpetual Access Easement- Tabled along with the Alley Vacation Resolution.
Approval of Disbursements. Motion by Luke Wetzel, seconded by Terry Ferch to approve the City’s disbursements. Unanimous vote. Motion carried.

Citizen Time
Chief Deputy Mason said things have been busy but fairly quiet for the department. Budget meeting is in 2 weeks with the commissioners for the drug task force. The department hasn’t heard from only 2 cities and has decided to move forward without hearing from them. Tim Sellner has mentioned that a pickup drives through town every weekend around 5/5:30pm honking their horn all the way through town and he has heard a few complaints about it. Deputy Mason said to try to get a license plate number and call the vehicle in when it happens again.
Dusty Balfe- Wondering if the tree by the library can be trimmed. Mayor Taaffe said it should be no problem.
Tim Sellner- brought up the sinking and uneven sidewalks and asked what can be done about them, Mayor Taaffe and Councilman Jeff said sidewalks are the responsibility of the home owner whose sidewalk it is in front of. Tim said he has tried multiple times to get in touch with the county to fix stop sign posts and he can’t get a return back to get the problem taken care of. Tim said he needs to order some curb stops and meters so he said the council will see some extra expense for the city water. Tim said he receives many complaints about the water, Mayor Taaffe said he needs to forward the complaints onto the city. Tim also brought up the fact that a property that has now been sold, the previous owner let the water shut off freeze and now needs to be replaced. He was concerned about going ahead and replacing this water shut off, but Mayor Taaffe advised him to replace it and give the bill to Tara, the new home owners should be informed from the old owners about the issue, it is not the city’s problem. Tim also mentioned they are in need of a pressure washer to clean up the water tower, Mayor Taaffe suggested he get in contact with David Hamele to see if he would be willing to do this. Mayor Taaffe then suggested he get some bids from companies to get this taken care of he can’t find anyone to take care of it themselves. Tim said he would get some bids on a new well house as well as getting the water tower pressure washed. Tim also said he was going to kick up some higher chlorine levels since people are complaining about the water smell but it will stay within legal limits. Mayor Taaffe told him to do what he has to do as long as it stays within legal limits.
Dusty Balfe – would like to see something get done with the storm sewer drain that always gets plugged in the old city lot across from the city library. Tim Sellner agreed and said he had tried to get something done with it in the past.
Council Discussion
KCHK Bid- Motion by Jeff Baldwin, seconded by Luke Wetzel to approve the option for 20 -30 second ad’s with KCHK. Unanimous vote. Motion carried.
Rex Bull – wondering what happened with the FEMA training. Mayor Taaffe said you can either do it all online or they could get a meeting scheduled for the council and fire department to have a city wide training day. Mayor Taaffe said he would contact Ann about this.
Jeff Baldwin – Said his weed whacker is currently out of order, of which Mayor Taaffe said he was going to ask about the weeds up at the park. Jeff said he was hoping the city would be willing to purchase a new one. Terry said she knows of one that could be borrowed in the meantime. Jeff also mentioned he lost the city card and a replacement was $10. Rex asked if the city should set a limit to buy the weed whacker, Jason said no need to make a motion; they will just have to approve it in the disbursements when it comes through.
Terry Ferch – Wondering what is going to be done with Crosby’s trailer. Mayor Taaffe asked Jason what the next step is after sending letters to have the property cleaned up. Jason suggested reporting it to the sheriff’s department or that the city could condemn it and then the city could own it, declaring it a hazardous property. Jason said to start out with the Sheriff’s dept.
Mayor Kevin Taaffe Jr. – Said he needs 2 council members to go with him to set up a performance review for City Clerk Tanya. Jeff said now and in the past he has had a problem with things that don’t get done within the job. Jeff and Luke said they would be willing to sit down with Mayor Taaffe to do the performance review. The council members were wondering if they could get Tara to come to the meetings, Mayor Taaffe said it is not in her job description to get be in at each meeting and that she has done an exceptional job and flat out said if she has to come to each meeting, the city will have to find a new treasurer. Mayor Taaffe said the city could look into making a clerk/treasurer position of which will open up a new ball park of things needing to be done/payed for.

Motion by Jeff Baldwin seconded by Terry Ferch to table the Resolution 2016-02 vacating a portion of a public Alley to start the special meeting at 7:00pm and move the regular meeting to 7:30 on Monday August 8, 2016. Unanimous Vote. Motion Carried.

North Lift Station Quote Rick Vollbrecht had a quote delivered from Minnesota Pump Works for the City about repairing the lift station lights that keeps coming back on. The council decided they would like a second quote from another business to compare for the August Council meeting.

Approval of Disbursements. Motion by Jeff Baldwin, seconded by Luke Wetzel to approve the City’s disbursements with the exception of holding Clark’s Check. Unanimous vote. Motion carried.
Impress Cash Fund. Impress doesn’t need to be reimbursed this month.
Citizen Time
Carl Villock is wondering what the ordinances are on vacant vehicles sitting in lots. Jeff Baldwin told him he thinks the church would probably have to write a complaint and the Sheriff would have to come check it out. He also had questions about camper’s sitting on the streets for long periods of time. Jeff Baldwin said he would be willing to talk to Tim Sellner about his vehicles sitting on the roads. But he said that if these vehicles are sitting on the roads and they have legal tabs, licenses and registrations he can’t do anything about that but he can probably do something about the camper’s.
Kara Hackett said a few people were up at the city park recently and they told her there has been some storm damage to the property, she believes there has been some vandalism to the back board. Kara also brought up that across from the bank there is a lot that has overgrown weeds; the council said it was Steve Stangler’s property and he said he will go out and spray it.
Kristina Mills brought some examples for the Halfway to St. Paddy’s Day advertising that she passed around the room to be reviewed. Janeice and Terry both agreed they all looked good but one of the examples needed a different font to make it bolder to read easier and also pop more.
Council Discussion
Jeff Baldwin is a little frustrated with always bring up the issue of the water shut offs and how they always get talked about getting fixed but never do. Also that the issues at the park get talked about being fixed and repaired but nothing happens with that. He would also like to see the streets being swept in the spring to help keep the drains from getting backed up with sand and gravel. Rex mentioned it would be nice to get the street sweeping discussed and settled upon for the next year in November or December so when spring comes, it’s all ready to go. Kara Hackett is going to get the city an estimate on dirt for filling in at the city park where the barriers for the playground is pushing back.
Terry Ferch got a call about a storm drain down by Mills where the sidewalk is falling in. Dusty Spitzack said it’s a deal where the ground is settling which causes it to bow in. Jeff Baldwin said that maybe someone should check to see if it could be a fire hydrant leak. Jeff also offered to go look at it if the city council would like him to. Terry also brought up Crosby’s trailer and asked Tanya to get ahold of Jason again on getting a letter to get the place cleaned up. Terry also said the fire department did testing on 2 new firefighters; Mark Hewitt a previous firefighter from Cleveland and Joe Dee a new firefighter. Both passed their testing and now the fire department is looking to hire them on. Motion made by Jeff Baldwin seconded by Luke Wetzel to accept the new applicants for the Fire Department. Unanimous Vote. Motion Carried
Luke Wetzel had a complaint about street signs that were taken down of which they are believed to be in one of the citizens of Kilkenny’s garage. Luke said Tim Sellner had told him he was going to take a look and see what he finds but has never heard back.
